  1. Introduction

If you do not agree, you must not use the Site or submit any form.

All content on the Site, including but not limited to text, images, the Maing’eng’a plumb-bob logo, graphics, and videos, is the exclusive property of Maing’eng’a Infrastructure Cadre or its licensors and is protected by Kenyan and international copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, modify, distribute, or create derivative works from any content without our prior written consent.

  1. Use of the Site 

You may use the Site only for lawful purposes. You agree not to:

  • Use the Site in any way that violates Kenyan or international law.

  • Attempt to gain unauthorized access to any part of the Site.

  • Upload or transmit viruses, malware, or harmful code.

  • Scrape, data-mine, or use automated tools to extract content.

  1. Contact Form and User Submissions 

Our Site includes a contact form where you may voluntarily provide your Name, Email Address, Phone Number, and Request/Project Details (collectively, “Submission Data”).

By submitting the form:

  • You represent that all information you provide is accurate, current, and complete.

  • You consent to us collecting, storing, and using your Submission Data to respond to your inquiry, send you project updates or proposals, and communicate with you about our services.

  • You understand that submitting the contact form does NOT create a binding contract, quote, or professional-client relationship. Any actual engagement for construction, engineering, or consulting services requires a separate written agreement signed by both parties.

  • We will not sell or share your Submission Data with third parties for marketing purposes, except as described in our Privacy Policy.

You may request deletion of your data at any time by contacting us (see Section 13).

  1. No Professional Advice or Reliance 

All information on the Site (including project examples, service descriptions, and any response to your contact form) is for general informational purposes only. It does not constitute professional engineering, architectural, legal, or financial advice. We are not liable for any decisions you make based on Site content or any preliminary reply to your form submission.

  1. Disclaimers 

The Site and any response to your contact form are provided “as is” without any warranties. We do not guarantee that inquiries submitted via the form will receive an immediate or specific response, or that any information provided is error-free.

  1. Limitation of Liability 

To the maximum extent permitted by Kenyan law, Maing’eng’a Infrastructure Cadre shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of business, or business interruption, arising out of or in connection with your use of, or inability to use, the Site or submission of any information through the contact form, whether based in contract, tort (including negligence), or otherwise.

To the maximum extent permitted by law, our total aggregate liability for any claims arising out of or in connection with the Site shall not exceed KSh 10,000. Nothing in these Terms shall limit or exclude liability for fraud, fraudulent misrepresentation, or any liability which cannot be limited or excluded under applicable law.

  1. Indemnification 

You agree to indemnify, defend, and hold harmless Maing’eng’a Infrastructure Cadre, its directors, officers, employees, and agents from any claims, damages, losses, or expenses arising from your breach of these Terms or your use of the contact form.

  1. Privacy 

Your use of the Site and submission of the contact form is also governed by our Privacy Policy https://unit.maingenga.com/privacy-policy. By submitting the form, you expressly consent to the collection and processing of your personal data as described in the Privacy Policy and these Terms.

  1. Links to Third-Party Sites 

The Site may contain links to third-party websites. We are not responsible for their content or practices.

  1. Changes to These Terms 

We may update these Terms at any time. Your continued use of the Site or submission of the contact form after changes constitutes acceptance of the revised Terms.

We reserve the right to terminate or suspend your access to the Site at any time, including refusal to process future contact form submissions, for any reason.

  1. Governing Law and Dispute Resolution 

These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kenya, starting with those in Mombasa County.
